The draft decree on the specifications of the eco-organisations of the extended producer responsibility (EPR) sector for construction products and materials in the building sector (PMCB) describes the various provisions that will fall under the action of the eco-organisations. This draft order was submitted to the professionals concerned by the EPR PMCB through a public consultation. The decree should be published in the first weeks of the summer.

The eco-organisation is responsible for the collection and treatment of waste from PMCB, as well as for the prevention of illegal dumping. It provides financial support to anyone who takes back this waste.

It is important to note that all the following information may change between now and the publication of the decree.

Premiums and penalties to encourage the eco-design of products and materials are defined by the eco-organisation according to the presence of hazardous substances in the PMCB or the use of sustainably managed renewable resources. In order to define these modulations, it must carry out a study to determine the possibilities of reuse of the PMCB, as well as the possibilities of recycling and incorporation of recycled materials.

The eco-organisation is subject to different collection and recycling targets during its approval period, and must therefore achieve them through the actions it puts in place. The targets are expressed by counting the quantities of used PMCB that are collected and then recycled or recovered in relation to the waste deposit. The general targets for waste from PMCB (excluding mineral PMCB) are as follows:

To achieve these objectives, the eco-organisation must carry out annual monitoring of the quantities of waste from PMCB and set up a network of take-back points in each region of France to which households and professionals can have access. The number of take-back points is defined according to the number of inhabitants and the number of jobs related to construction in a given area and according to a distance of approximately 20 km between each take-back point. Similarly, an eco-organisation is also subject to a collection and reuse target:

The draft specifications stipulate that the approved eco-organisations may, during their approval period, carry out studies to revise the collection, recovery and reuse targets.

The implementation of the EPR sector will be gradual, and the draft specifications provide for several deadlines, including complete coverage by 31 December 2026 at the latest and the acceptance of waste from joint collections provided for by the 7-stream sorting system (including wood) from 1 January 2024.

In the event that several eco-organisations are approved for the same approval category, a coordinating body will be responsible for ensuring that the proposals of the various eco-organisations are consistent. For example, it will ensure that there is a single, coordinated network, that collection methods are consistent, and that data is made available to the public.
