The AGEC law of 10 February 2020 provides for the establishment, particularly for EPR of waste furniture, of funds dedicated to financing repair on the one hand, and reuse and recycling on the other.

The furniture sector must implement these funds from 1 January 2023.

A draft order has been issued to complete the specifications for the approval of the sector’s eco-organisations in order to specify the terms and conditions for implementing this fund.

The current text provides for the creation of an action plan, the creation of the fund dedicated to financing reuse and recycling and the transmission by the eco-organisations of the elements relating to this fund before 1 January 2023, the carrying out of a study before 30 June 2023 with a view to proposing reuse and recycling objectives for the next approval period which will begin on 1 January 2024.

In terms of repair, the eco-organisations will have to draw up an action plan to develop the repair of furniture items, set an indicative target for monitoring the increase in the rate of non-warranty repair of furniture items by 2028, allocate a minimum amount of financial resources to the fund each year, and transmit the terms and conditions for the use of the fund before 1 January 2023.

This draft order is subject to public consultation on the dedicated platform of the Ministry of Ecological Transition
